Under the previous law, drivers had the right to refuse a blood or breath sample unless they caused a death or serious injury. But under the new law, police can take blood from an arrested driver who causes any injury, has a child in the car, has a prior DWI conviction with a child in the car, or has two or more prior DWI convictions.

"We need the message to get out to the public that you can't refuse tests anymore. You're going to get caught," said Brent Mayr, Harris County Assistant District Attorney.

Across from Houston's downtown criminal courthouse, defense attorney Dane Johnson is blogging his opposition. He showed us a video of a terrified man who's forced to have his blood drawn after getting pulled over on suspicion of DWI. Johnson argues a warrantless blood sample is too invasive.


"Allowing a police officer on the street to make that call on his own is incredibly offensive and a slippery slope into officers taking further and further actions."

Makes perfect sense. It is not like just anyone getting pulled over will be tested. Sounds good to me if you are not drinking you should have no issues.

What I do NOT like is it being left up to the officer.


And your poll is not a good description since it is NOT everyone, you have to fall into one the the groups listed.

Once power is given to authorities, it is very hard to get back. Can you think of any power given to the police, or any other government agency that has been abused?

I can name several myself, but you just keep on thinking they are only looking out for your best interest.
