The enviros do the same. Environmentalists, like the ACLU, use lawsuits like big businesses use sales. It's simply American capitalism at its best.

I will need to research specifics and get back to ya but each time they win a case, the losing party has to pay legal expenses and whatever monetary compensation that's awarded to the plaintiffs. Not only does the ACLU limit freedom of speech, they exhort money from organizations via the legal system to win their cases.

I think it is exhortion and coersion, pure and simple. Maybe folks who support these type of organizations should not be crying about our deficits and governmental service cuts because these frivilous lawsuits are costly.

Well, as a thought experiment - and I realize this is a wild, blue-sky, unrealistic idea - those public agencies you're so worried about could modify their behavior and stay within the borders of the law.

Then they'd start winning in court. What a concept, eh?
