I was about to sign a contract to buy a condo, however, I will walk this time. The lawyer I hired wasn't very client-oriented at all and did not want to do his due diligence of getting the financials and minutes of the Condo board. Anyways, the lawyer drafted a rider to the sales contract and submitted to seller's attorney. After some back and forth, seller has decided not to move forward. What are my obligations? We did negotiate a fee if the deal doesn't go, however, I assume that is if I had SIGNED a contract and it didn't work out. Since no contract was signed and he doesn't have my deposit, I am not sure what the next step would be. We only spoke a few times on the phone. Any advice would be greatly appreciated.
If you had used a Realtor instead of a lawyer you wouldn't owe anything and she probably would have been on top of getting your condo docs promptly. Realtors wind up working for free all the time. Lawyers, not so much. Let us know how Slim Shady reacts to your not paying.
You verbally agreed which is just as binding. You need to pay what you verbally agreed to. He did do a service and needs to be paid for it. (albeit reluctantly but he did it)
Play. Pay. Usually the attorney will say , look, I wrote a couple of letters....made a few phone calls... Make it $500 and we'll make it up on the next deal.
If you had a signed purchase agreement, you could potentially (depending on why) go after the seller for expenses since they backed out, but you have to pay the attorney for their services.
