WFTV - Orlando, Fla.

OSCEOLA COUNTY, Fla. —
An Osceola County man returned to his home recently to find a line of cinder blocks cemented down the middle of his driveway. He said his neighbor did it, claiming half the driveway was on his property.

"I just hate to be bullied," homeowner Oliver Lynch said.

Lynch said a new neighbor building a home on an adjacent vacant lot decided part of Lynch's driveway was his property.

Get it surveyed asap. Saw this before up north. If he's a new owner he should have had his land surveyed and the marks should be there.

It seems to me that this concrete block setter upper could have gone further and put a fence..But he best have some sort of survey that would prove such a thing...Surely Mr. Lynch has some sort of property Survey??? Guess it's going to have to go civil court to clarify who has the rights here..

I have a question tho..How long has Mr. Lynch lived there?? How long has the neighbour who put these blocks in place lived there..Loads of missing background informations..So can't reply as to whether it's bullying or just plain standing one's ground on intrusion onto one's property...??

Customary and traditional use goes a very long way in court.

Based on the angle of the existing partial fence in the video and pictures, it appears that the new neighbor is probably correct....

Even if the lot line is down the middle of the concrete strip, Mr Lynch may have a case for adverse possession.

Even if part of the driveway is across the property line, he would have a good case for adverse possession if the driveway has been there for 25 years. In any case, it sounds like he's going to have a nightmare for a neighbor.

Yup. Agree with that assessment!

Of course, it could be a 2-way street, and they each could be the other's nightmare! But glad it's not my property!

I'd love to know the guys name. I had a neighbor like that. He was ready to tear my garage down and almost yanked out a line of bushes. Unfortunately for him, his survey showed I owned more than we thought. Ironically, he moved to Florida in 2004
