The seller's agent may have knowledge of another offer that is coming in shortly or may be trying to get more offers to start a bidding war. I always walk in this scenario as I do not like to be involved in bidding wars. But it really depends on how much you like the place.

Dh, who is the one who signed the offer/read it, just saw that the offer is null and void after 10 days. 10 days seems like a really long time to wait on an answer. I just asked DH who made this time frame, the agent? and why he didn't ask about it
Because our house was new on the market and we had multiple people really interested the first offer came in about 9 or 10 that night and we had to respond by 9 or 10 the next morning. Since it was full price we accepted.
If it has been more than two days, have your agent contact theirs and let them know your offer will be rescinded in 24 hours unless there is a response then move on. You may hear back that they are out of town or something and at that point you might give a bit more time but more than 3 days to respond is not normal unless they've stated to put offers in and we will decided by such and such a date.

They are either not that serious about selling or are waiting for other offers to come in. I have never heard of 10 days to hear back, that's ridiculous!
Well you could tell your realtor that you want an answer by Friday morning or you'll walk, but I guess it depends on how much you want the place? They are probably waiting to see if any other offers come in during the weekend.

Ok. So now our agent calls DH today and the new story is the sellers agent is now away on vacation, so that is the hold up. He is not even getting a clear answer on wether or not our bid even made it to the sellers. This is the 3rd story now. I thought the hold up was because they were busy with work. I decide to call the sellers agent, did not give my name but asked about the listing. She seemed to stumble a little and tell me the condo sold yesterday. This is sounding pretty shady now...

I would put money on that they are waiting on other offers.
A very similar situation happened to me at least 3 times. In my experience, if a seller is excited they respond quickly. If they hate your offer it's also a quick no thanks. But if there's a delay.... they are expecting more to come in.

this is the best answer. Heck, you could even have your agent email the listing agent, and the listing agent's broker that you expected a response by now, and it's been X days ,and that you require an answer by 10 pm tonight or your offer is null and void.

This is in NJ and not sure if there's any laws for this? And how long should a potential buyer who made the offer wait? If there is no "expiration" date on the contract, could a seller come back say 3 weeks later deciding to accept an offer? Is this some sort of tactic to wait until they get higher offers? Agent of potential buyer is giving exact time frames like "Oh, they are busy with work, so haven't looked it over but will tonight" or "they will know by such and such time," but still no answer? Wanted to add this is a full asking price offer with contingency of inspection.
I always put a 24 hour expiration on any offer I make. They need to fish or cut bait.

I would call the listing agents managing broker. Or better yet, have your RE lawyer call!
