Own a unit in a building that turned co-op in upper Harlem off St Nicholas.. The tenant has not paid rent in several months . I am a senior citizen living in North Carolina and am unable to go to NY often. Also, the building maintenance fees are over $400. a mo which I have not been paying. The tenant assoc. president is supposed to be handling rent collection for me and also trying to find a buyer for the unit but she has not done anything. She gives me the run around when we talk. What is my recourse if any and how do I get these loafers out of the unit so I can either rent it again or sell it?

Hire a Realtor who is also a property manager and they will know the steps that are needed for your particular circumstance.

Everything starts with some sort of formal notice of default, or non-payment of rent though. So if that hasn't been issued, you're still at square one and letting valuable logistical time slip away each month.

I'm only guessing that the eviction process in NY is much different than Texas, where we get deadbeats out in less than 30 days for non-payment of rent cases. 4 months is not acceptable and I think it's simply due to inaction. Find out what has to happen and get it started, even if it means hiring an attorney.

Is there a local sheriff who can enforce the notice of eviction?
