Hello, I live in the state of California and I have been living in my mother's home for 3 years. We never had a written agreement regarding rent, utlilities, etc. I pay for bills, groceries and household items.
My mom recently decided to sell her home. I was aware that the home was in escrow only because of a sign was put up stating so but she never let me know when the escrow was closing or by when I/ we would need to leave the premises. My mother informed me 2 days ago, late in the evening that, I had 7 days to vacate the home. I am doing my best to find a place but with such short notice it is nearly impossible. What are my rights in this situation? I would thing that legally she would need to give me a written 30 day notice.... I wanted to check as this may vary from state to state.
The problem is that you're not a tenant in the eyes of the law. You're someone who lives with your mother and helps out with household bills so I don't think the court/legal system can help you out here and the laws just don't apply. There must be something else up other than the sale of the property that your mother wants you out in 7 days ...
I'm not so sure about that...we had one time a buyer who had to go to court to get the sellers son out of the house who never paid rent. We worked as a transaction agent on this deal and the mom was desperate since the buyer at first didn't want to close unless he was out and than they agreed that the mom would pay the eviction fees and the buyer would evict the son.
Lawyers stated the son had the right to 30 day notice but he ignored all that for at least 2 months.
