We gave a written notice not to renew and we got a letter back stating that we didn't give a 60 day notice but we actually gave a 52 day notice. Now I looked at me lease and it says 30 day notice for lease and 60 day for month to month. They said on the letter they can prorate that move out day and we would pay for 8 days in the apartment after the 1st. Can these terms be negotiated. I know a 52 day notice is not 60 and they're saying we may have to pay the difference in those 8 days by them pro the days to the 9th of the month we'll move out. Since it's an 8 day difference could mgmt negotiate a deal on this or is it set in stone. Btw we rent in TX. Also could we negotiate with them especially when we've been trying to get the vent in our bedroom fixed and it's never been fixed and doesn't blow any air. Lately the weather has been in the 20s and 30s

The only way to find out is to talk to the landlord.

The sad truth is that most PM Companies *live* for these situations.
Every extra penny they can extract from you goes straight to their bottom line.

I think it's something that mgmt should be able to help you out on. I think I may call the corporate office to see if it's something mgmt can work with you on before I approach mgmt here at the complex because 8 days man come on smh.

You said you gave notice not to renew.... right? That means you have a lease. Then you say they told you it's a 30 day notice for leases. Aren't you on a lease? So you'd only have needed to give them a 30 day notice.

If your lease states 30 days, it is 30 days. If they are using a standard TAA lease that will be in paragraph 6 on page 1 of your lease. If the space is left black and does not specify a number of days, the default is 30 days. Also it should be contained on your original application as to what their notice to vacate is.

Month to month can be different than what the notice is for when the lease is up, which you will want to contact the apartment community as to what they require for MTM. But you are ending at the end of your lease term so that shouldn't be an issue.

It may have been a term lease which rolled over to a month to month.

Very true. OP doesn't say which but after reading it again it could go either way depending on if MTM or in a Lease.

It's a term. I'm still in the lease. The lease is up 3/1. Let's say they do require a 60 day notice. I gave them a 52 day notice so on the letter they stated that they would pro rate the move out day to 3/9. Which means they would charge me money for those extra days or be subjected to pay 2600 plus. My question is can this situation be negotiated especially when we leaved in the apartment for 2 yrs and the vent in the bedroom never worked. We put in numerous requests and was told the last time that it would be a heavy fix because of the building structure. I would like to know since this has been happening does mgmt have to say so to negotiate this last price with the situation of the vent not working. Is that a good enough reason to negotiate?

Why is there anything to negotiate? You said, "Now I looked at me lease and it says 30 day notice for lease and 60 day for month to month." If that's what your lease says then you only are required to give 30 days notice - but that makes no sense. Did you misread it? More logical would be a two month penalty for early lease termination. I think you need to sit down with them and have them explain exactly what the lease says - or ask a lawyer to look it over.

As far as the vent is concerned, I doubt that this would be anything you can use as a negotiating lever, particularly when you lived with the vent not working for two years and didn't kick up the huge to-do that you would have done if it really was a major issue. Likely it's indeed a structural issue and the wall will have to be pulled apart to fix it.
