Hi guys,

my landlord uses RUBs and since January, the price of water has almost doubled.

RUBS (50%) - 1 occ @5.05032 per occ $5.05

RUBS (50%) - 921sf @8.21864 per 1000sf $7.57


to


RUBS (50%) - 1 occ @9.63919 per occ $9.64

RUBS (50%) - 921sf @15.7814 per 1000sf $14.53


Is this legal? (California)

What does it say in your lease about paying for water?

And what is RUBS?

My contract details that the owner can change the method of utilities and use a billing agency.
Basically, they guestimate my usage and use a billing agency to obtain water payment, not through the local water company.

But they've been charging more and more every month for water and I fear by next year I will be paying $77/month.

May 2014 $42.xx

Sep 2014 $48.xx

May 2015 $50.xx

Sep 2015 $59.80

It must be legal according to the link you posted. Your only hope is to contact an attorney or legal counsel in your area who is familiar with this or as stated in your link:
CONTACT THE CPUC
If you want the CPUC to hear your opinion on the matter, Contact the CPUC and be heard

At the Tenants Legal Center, we review each water billing case presented to us by a client to find ways to fight any unfair billing practices. Unfortunately, without some consumer protection action by lawmakers, it remains a difficult situation for tenants.

Thank you for the information. I think the illegal part, if found illegal, is that the inflated prices could be considered "reselling water", which is what I'm hoping for if it turns out this way.

Is it possible that the water shortage has caused the price of water to go up? The smartest way to reduce consumption, IMO.

I just e-mailed the water company about water pricing, so we'll see.
And I do live in the desert (Coachella Valley).

It's disconcerting that the price is going skywards while I'm conserving so much water, so I might as well not conserve if the price is going to be so high no matter what. I've settled on moving next year.

After reading CA state law on water utilities, I found that they may have been charging 2.4x's the amount required by the state for late fees on water too. ($7 over 20 days state vs $15 over 3 days)

Update:

The water company says that water usage and prices have not changed for the building I'm in and that the landlord is being penalized for a lack of conserving outdoor water use via the state mandate.

So, the landlord is charging me for them overusing outdoor water throughout the large property.
