I purchased a car from someone in New York and had the car shipped. They sent a title that is improperly assigned that shows them as the buyer and some other person as the seller. When I went to DMV they said I need a reassignment title from New York that shows them as the seller so I can sign as the buyer and get my own title. But the seller is making up some b.s. about how I have to pay HIS New York sales tax since he's a dealer before he will get the reassignment title. Basically, he's trying to cheat me. Anyone have any advice? Is there any way for me to get a title in my name since I have a title certificate but it's assigned to the wrong person? I dont want to send this guy any more money with no assurance that he will do what he's supposed to do. Please help!

This may help you with the process if you have a reciept from him as the last owner.

The seller never had the title transferred to his name. This may be worth a trip to NY, as it will have to be passed through him and then to you. Yes, taxes will be due, and he is trying to cheat you.

Are you sure it's filled out wrong? If they bought it and sold it to you without registering it, it can be dealer reassigned. You've just need a notarized reassignment from them. I've bought 2 cars in that same situation.

Also, are you from Southie?

If the dealer was really a licensed dealer. If not, VA will not accept a filled out title no matter what documentation you have. The OP needs to travel to NY with reciept in hand to the DMV and bring proof of VA residency (deeds and bills). They will usually have to pay only the titling fee and not the sales tax. If you pay the sales tax there, you wont have to pay the sales tax here.

if you purchased the vehicle within the preceding 12 months, you must provide proof that the sales and use tax was paid elsewhere in order to be exempt from sales and use tax in Virginia.
As to the person who sold you the car, yes you were scammed. Contact NY DMV directly.
