I purchased a condo which has a man made creek outside my backyard which runs into a pond below. After living there 5 years my basement flooded. After the investigation it was found the concrete creek had massive cracks in the bottom adjacent to my home in which the water found its way to my basement. The cracks were due to lack of maintenance. Is the HOA or there insurance company 100% responsible. They say no.

I don't know why you would be responsible. Who maintains the creek? City? HOA? Based on what you are saying you might sue them.

Is there need for insurance for such things in your area? What are your neighbors doing?

also do you or HOA carry flood insurance? who owns the creek?

The HOA may fix the cracks and stuff but what about stuff in basement that was ruined
