A coworker received the " Notice of Violation"

Oddly, the notice came from a company called Intersection Safety Program located in Tempe, AZ - 85285-2091 and the payment address is in Cincinnati, OH 45284.

Looks like Hillsborough county has outsourced the contract to a private firm in AZ since it says this notice was issued by Hillsborough County Board of County Commissioners.

There was a video posted on www.violationinfo.com

We were debating if this violation was considered a ticket. However, the notice says that if we don't pay then a UTC will be issued.

Trying to understand how non-payment will result in an UTC.

Edit: It shows signed Dep Donna Rodriguez ABN#4147 so these notices are indeed signed by someone from local Sheriff's office?

You need to check the local media.

A company in Arizona installs and manages the cameras. After they take their skim for the camera management, a portion goes to the State of Florida and the rest goes to the County. They send the video to the HCSO for review, as an LEO must review them for it to be a traffic infraction. The payments go to Cincinnati to a bank drop box.

Notice that you can:
  1. Pay the charge
  2. Ignore the charge (and get additional fines), or;
  3. Challenge the infraction, which requires an appearance and if you lose you have to pay additional fees over and above what you're being charged with now

It's a scam in my opinion, plain and simple. There is a very vocal opponent of these over in Pinellas who has proven time after time that they do nothing to decrease accidents, they merely generate revenue. Take note that when they were originally deployed, yellow light times were often below the state minimum at these intersections, making it near impossibly to clear the intersection in the time allotted. When that was pointed out, they suddenly got "adjusted".

True.

It says If you need to get an Administrative Hearing before a Local Hearing Officer then You have to sign the violation and mail it to the Cincinnati P.O.Box. Just doesn't make sense.

1. Shouldn't this company have a local presence like how other companies are required to have their own LLCs incorporated under Florida laws?

2. Is the LEO same as LHO(Local Hearing Officer) ?

3. Also, how is that a private company has access to DMV records? Is our name, address, car registration details public info?

Has anyone contested a red light ticket issued by this private company? or has anyone NOT paid the ticket and received an UTC in the mail?

Do some Googling and you'll find your answers.

People have challenged these citations successfully, but you have to be careful about it.

There's a lawyer going around social media telling everyone to burn those tickets. He claims (I'm not a lawyer, I don't know if this is true) that there is nothing that can legally be done for not paying that ticket. It's not issued by a cop.

Update: Co-worker had ignored the initial letter - now, apparently the private company based out of AZ has sent certified letter stating a FL Uniform Traffic Citation has been issued and fine is now $251 as opposed to the original $158.

Yikes...

so they have 3 choices:

1. Pay up.
2. Request a hearing.
3. Send an Affidavit - Copy at www.violationinfo.com and you need to confirm the identity of the driver for a specific citation so they will be sent a copy of the citation.

I just sat through court a couple of weeks ago for a ticket that got dismissed, and the judge was pretty cool about the red light tickets if you were appearing for one. He pretty much told everyone he didn't like them and that if you plead no contest he would knock the fine down and wouldn't even make you go to traffic school.

I believe No contest doesn't mean your case is dismissed. It simply means you don't agree that you are guilty so you pay reduced fine and the act of paying reduced fine causes your case to be dismissed.

Anyway, there is NO traffic school requirement for red light tickets if you received citation based on a camera as opposed to being issued by a police officer.
