Hello,

Live in Washington state.

Claim 1: filed in Apr 2008 and used up full state benefits plus partial Tier 1

Claim 2: filed in Mar 2009 and used up partial state benefits until BYE

Claim 3: filed in September 2010 and used up full state benefits and transitioned back to EUC from Claim 1

1. Did filing Claim 2 cancel my eligibility for EB from Claim 1?

2. I didn't collect EUC before BYE in Claim 2 and Claim 3. Does this mean I cannot file another EUC claim? My Tier 4 from Claim 1 runs out in April 2012. I'm not eligible for a new state claim.

Yes. There are no further benefits available when you have exhausted Tier 4 from the first claim.

If you had been eligible for EB under that claim, the EB fix under the new legislation would have added ten weeks to your tier.

Without EB eligibility, I do not think WA state will consider your claim eligible for the additional ten weeks.

However
, the legislation is so complicated, WA's computers might just give you the extra ten weeks. Whether or not at some point down the road WA will want its money back, remains to be seen.

Right now the states can't even agree on eligibility dates for transitioning to the reduced tiers. I can't imagine how they're going to be applying the EB fix. I expect many inconsistencies among the states going forward.

Is there any way for me to recertify or anything to allow for a new EUC claim? Sounds like I'm out of luck.

Regarding EB, WA is not scheduled to trigger off EB until May 12. If this is true, it is going to be unlikely for the TUR to be above the 8.5% required for the EB +10 weeks. Do you see it this way, too?

You need a layoff and/or new eligible earnings for a new state claim. State benefits are paid before EUC, always. Under EUC regs, WA will continue to check your claim quarterly for new state claim eligibility. Next quarter 4/1. Only thing you could collect are state benefits on a new state claim and possibly EUC on that claim if current and future legislation allows. If you have no new earnings, no new claim.

Can't help you. BLS hasn't announced Jan unemployment rates. Just got an email back saying they always report Jan/Feb in March. Jan. not being reported until 3/13. Therefore, no way for me to conjecture on WA's TUR.
