We were approved by the HOA 10 mos ago when we moved into this development in Boca Raton. The owner we rent from is losing the villa to the bank in foreclosure in 6 wks - the owner did NOT tell us the unit was in foreclosure when we leased from them, though we DID ask several times. Now we find ourselves scrambling to move... We found another villa in the same development, and have been approved by the new owner. We want to move in by Jan 1st, and the new owner wants that too. Do we have to go through the whole HOA approval all over again? We are the SAME people, SAME info, and we already paid the app fees and went through the HOA screening/meeting 10 mos ago. Anyone know? If we have to wait the 3-4 wks again for HOA re-approval it will be a problem. Help??

The only entity who can answer your question is the Board of the HOA. Ask them.

In the interest of time, call them Monday first thing and have the new landlord get in on it too, stressing the timely nature and neither of you wanting to get messed up.

Where we lived we had to pay and apply twice. We were renters that bought a unit on the same street. HOA's want the $$.

Had same situation and No, only applied once and all paperwork just transferred easily to new address. GL.

I don't know if you are aware, but you are afforded certain rights as a tenant under the Protecting Tenants at Foreclosure Act of 2009 that might serve to help you in this transition like:

1. The buyer of a foreclosed home must give tenants at least 90 days’ notice prior to eviction.
2. The buyer must also allow tenants to remain in the foreclosed home until the end of the lease, except in the following cases:
A. The foreclosed home has been sold to someone who plans to make it his primary residence; or
B. There is no lease or the lease can be terminated at will if state law allows.

***Even in these circumstances, the new owner must still provide tenants 90 days’ notice of eviction.***
