You have already reported the problem. He has been called to the office. You so far do not even know if he will be going to work tomorrow. You should wait, to see what happens before you start making plans to do something or not.

If that man worked for my company he would've been fired for 'creating a hostile work environment' and for 'workplace violence'. He also would've been put on a hiring ban of 5 years or indefinitely.

I was at the conveyor already and just let the box go. He was just trying to control me because the box was small and the conveyor had plenty of room on it. Well because I did not do what he commanded of me and because he was mad about being talked to, he took the box off and kicked it at me. It hit me in the leg. I flagged down a supervisor right away and told her what he just did. As I was punching out I learned they took him to the office so I wiil have to wait until the next day to see what will happen. My question is, is the box kicking workplace violence? The supervisor told me he should not have kicked a box at me. What do you think they will do. He was already warned to stop but he stilled kicked a box at me.
You could make a decent case for that. Heaven knows, he was already engaging in workplace violence when he was abusing you verbally. You risk being needled by some of your better-meaning co-workers about getting a guy busted for workplace violence when all he did was kick a small empty box at you, but if you can deal with that, go for it.

Now if you wanted to be SURE it was workplace violence, he'd have to have come in with a machine gun and mowed down several of your unarmed innocent co-workers while shouting about how Allah is great. THAT, my friend, is workplace violence.

I think thery will fire him. then he will go home, get a gun and come back looking for you. I'd look for a new job. Also, grow some thicker skin.
