There is no doubt that there are those who will opt for the free ride that the Janus decision may now provide. While most of the solid blue state legislatures are moving toward protecting their state and municipal unions, there are vulnerabilities. In states where government employees can be victimized by less friendly state governments, the Janus decision may now weaken their unions. This weakness may manifest itself in weaker contracts and outsourcing of jobs.
In these states where the legislature is run by Republicans, you need your union more than ever. What I mean is, don't opt out of your union if you are lucky to have one to begin with.
Offshoring and outsourcing is all about crony enriching at the expense of everyone else.
As long as politicians (blue state, red state, doesn't matter) care about themselves and their cronies, it doesn't matter abuot this court decision. The crony enriching will continue as usual.
Outsourcing has been going on for years. Many government call center operations are actually handled by inmates at private prisons all over the US. Even local jails can be contracted services. It's very common for some local and state tax payments to be processed through regular private processing companies. Legal and attorney services are routinely contracted out. Have you inquired if your school's cafeteria services is government ran or is it a contracted cantering company operating the service? Trash collection run by private waste company. Street maintenance now being fully contracted out. Welfare programs being run through private organizations. Building permits and inspections are also widely handled by contracted inspection services. Even many schools are actually independent non government (they pretends to be government) education districts that are private corporations in reality.
Some service will traditional remain civil service or must stay under government control, but more and more will be privatized to maximize corporate profits even at the expense of taxpayers. However, that's what americans want so they have no reason to whine and cry when ti happens!
I agree that there is outsourcing already. What is troubling here is that weakened unions will not be able to take a tough stand against layoffs with the intent to outsource.
If only state legislatures would move to protecting the electorate from the powerful unions.
I will answer you with a case that I've been following down in Florida.
Leo Perrero worked for Disney. Disney teamed up with an outsourcing firm to replace their programming staff. The outsourcing firm replaced an entire staff of Americans with H-1b labor.
Leo Pererro sued Disney civilly siting RICO violations. Essentially he accused Disney of unlawfully filling out H-1b requests saying that there were no available Americans to fill the jobs.I think that they also had to train their replacements. Disney was also accused of conspiring with another company to break the law thus violating the RICO Act. This never got past an Orlando judge. The charge of replacing the Americans with foreign labor never made it to a jury. It was dismissed. The RICO charge was never mentioned in the dismissal.
Had there been a union involved, would Disney have ever attempted this?
