lawyer fees and taxes settlement with an employer

hi everyone;
we settled out side court with my former employer for overtime and harassment, so I will get total 10000$. the lawyer fee is 4000$, do I have to pay for his taxes or I only pay 6000$ for my taxes??
what are the options? do I get to choose how to get pay using W2 form or 1099?? I ask because if I get pay with w2 the employer probably tax me the whole amount of 10000$. also the othe question is can me and my lawyer request my former employer to write 2 different check one for the lawyer fees and one for me?? can I choose how much ill be tax using the w2 add more dependant? please I need detail or step by step, thank you
