Since they pass the law in Arizona where they can pull anyone over and ask for ID, have the police taken this law to far? We are thinking of moving to Phoenix but people keep warning me about this law.

The law was never put into effect because the courts blocked it.

Where are you from? Sounds like people there aren't very informed about the law, no offense.
It's not "the police can pull anyone over and ask for ID"...it's "the police can ask for ID from anyone they pull over". And there not completely true either...it's that they can ask your legal status.

Obviously if you get pulled over in any state, the police are going to ask you for ID. The difference with this law is that they could also ask for your legal status and if you couldnt prove you're here legally, they could call immigration.

HX summed it up pretty well .... most of the law is tied up in the courts, so it really hasn't been much of an impact

Generally people have no clue what they are talking about and it doesn't sound like you are getting informed advice at all .... when I moved out here I heard about all sorts of reasons why I shouldn't - from people who had never been here

come out and make your own opinions

In Hiibel v. Sixth Judicial District Court of Nevada, the U.S. Supreme Court upheld the conviction of Larry Dudley Hiibel. It require persons stopped under Terry rules, MUST show ID, but persons not suspected of a crime do not. The police are free to ask for ID, and you have a legal right to REFUSE to provide it. The driver of a vehicle pulled over by police would have to show ID, but the passengers do not.

As for SB1070, it's not really even enforceable - US Citizens are not required to carry proof of legal status, and those who are here illegally aren't likely to admit they're here illegally...

I take it you are refering to HB1070 ? No, it didn't

pass. They still have to have reasonable suspsion or
catch you breaking the law..

An interesting side note: we spend our summers in Ajijic, Mexico, 40 miles south of Guadalajara. We drive our AZ plated vehicle here. Last year, after SB 1070 passed, we wondered a bit if our AZ plates might make the car a bit of a target.

Nope - in fact, on two occasions, local Mexican citizens commented that they didn't understand why America didn't Already have laws like this for non-citizens. After all, we are required to carry our visa's with us while we are visiting Mexico. (and have had to provide them to police when we were stopped for a traffic violation - but we received no ticket, no hassles, no demand for cash, just a courteous warning and wave goodbye.)

On the other hand who is to say that a cop cannot pull you over for almost any reason he wants to and ID you.
Come on people.
All they have to say it they saw you weaving or any number of things.
I have known a few LEOs in my life.

What about the Federal Border Patrol checkpoints that are throughout southern Arizona? Can you refuse to show ID at them?
