I can tell all of you for a fact that the law has been like this for at least 14-15 years as I had to fight one in 2000 "for one beer on the way home". I won't go into all the details, but I did have to hire an attorney and had to take it to a jury to beat it.

I do not believe in drinking and driving, but the laws do give way too much leeway to the state.

At least that section of the law requires you to be impaired if only to the slightest degree. Another section gets you a conviction - by presumption of impairment only - if you have metabolites of marijuana in your blood. So even if you smoked days or weeks before, you still are going to be convicted. Not only did the legislature pass this, but the state courts recently upheld it. Let's be frank. DUI is a huge money-maker for Arizona. Not only that, but many in the legislature have questionable relationships with the private prison industry that is building prison after prison in AZ with many of those cells to be filled by DUI convicts.

The metabolite section has been changed. Officers now have to show impairment with marijuana too.

I didn't see it in the latest legislative session. Would be a smart move, but there have been recent cases upholding.

See, that's just wrong. There are senior citizens who are barely able to drive who are much more dangerous to other people than a guy who has a beer on his way home.

Does anyone know how these laws are passed? Do AZ citizens vote to pass it?
