Sorry, but this situation is just like in soap opera: a woman moved into her BF house in June 2014. He told her he loves her and in close future wants to marry her. He asked her and she changed her DL to his address. Late November he told her he is not in love anymore and does not want to continue a relationship and she needs to find a place and move out.She lost her full time job late September, collects unemployment and is looking for a job with no luck so far. She cant rent a place, need a job to support herself and time to get on her feet. He threatens her by police, that police will move her out if she does not move out on her own on Jan 31st. Someone told her that it is not true, there is a law in AZ, nobody can move her out unless she does it by herself. Does anyone know about this law? Thank you

Generally speaking, and I don't know the laws of AZ specifically, if someone lives in a property for 30 days, legally they are a tenant whether any rent is being paid or there is a written lease, or not. Legal eviction proceedings must be followed (Notice, court filings, hearing, etc). Your "friend" needs to go to the court in her jurisdiction that handles evictions. They usually have handouts and pamphlets about the eviction process for various reasons. The police are unlikely to do anything unless there is a TRO in place; this is a civil matter not a criminal one. My suggestion is that she consult an attorney for legal advice.

This scenario is a lot more common than you might think.

Way more common.

Neighbor had a roommate she found through roommate.com. He didn't pay rent. One unfortunate situation after another. Then things went missing. She called the police. He said he was staying until she went through the formal eviction process. Police officers said there was nothing they could do, this was his home. Seems he was familiar enough with the situation to know he didn't even need a lease, as long as he'd been there 30 days.

She changed the locks and put his stuff on the porch. He apparently found another roommate as that's the last she heard of him.

No.

If she has been asked to leave and doesn't leave, the owner of the house will file for eviction. The judge will grant the eviction, and the local sheriff will toss her belongings out into the gutter. Once her stuff is in the gutter, she will have to scramble to get it secured because the local vultures will swoop down and take whatever they can get their hands on.

The house isn't hers. The relationship is over. She needs to move on with her life.

She should look for a place to live where they are looking for a roommate. Get the heck out of there and move on instead of trying to stay. Or stay with family or a friend. Don't find her ways to stay longer.

Under AZ law she is a month to month tenant and her landlord/boyfriend has to give her 30 days written notice to leave. If she fails to do so he can file for eviction through the court. You'll find state landlord tenant laws linked in the first "sticky" in the Renting forum.

Really need to consult an attorney. And the sticky in the Rentals forum sounds like a good start.
