My subdivision is 6 years old and it has not been turned over to the owners yet.

However the HOA management company will not tell us who the directors are that oversee the HOA.

The only response we get is that the developer is still in charge. The developer is still in business but when asked they say they turned it over to the home owners.

Does anyone know what Georgia government agency oversees this area?

Either HOAs in general or HOA management companies?

Dexter, go to the Secretary of State site and look up corporate entities, including HOA. That will give you information on who is the registered agent, officers, etc.

Is your subdivision completely built? I ask this because my subdivision HOA is run by Sentry Management. They are supposed to turn over the turn over the HOA to us owners when a certain percentage of ownership exists in the community. While there lies the issue. My community is only half built. The builder did just put in referendum to build some more homes to complete the community. They want to change from townhomes to single family detached homes....we shall see....oh my builder is Richardson Housing Group

Yes, go to the Secretary of State's corporation site:

Corporation Search

Type in the name of your subdivision -- for example, if it's Lost Hills Estate, try typing in Lost Hills and see what pops up. You can then examine the registration documents for the last few years, and see who the current officers are.

Your RE closing attorney is another way to get the info you need. They should still have all the info in file.

I live in Sandy Springs. Condo. Our fees go up with no vote from homeowners. Services have been decreased (no hall cleaning, potholes, pool closed, fences not repaired, trash everywhere)

Georgia needs some type of oversight for HOA's. We have the laws, just no one to enforce. Entrenched board members can do anything. The only thing that is enforced is 'paying the fees'

Run for the board and change thing, Get a group together and take over the board.

Fee's don't need a vote of the owners, You vote in the board, They determine the fees.

Read your covenants as this is a civil matter. There should be procedures to demand a hearing with the board to get the answers if the HOA rep won't disclose info.
