3 person apartment. 3rd roommate decided he didnt wanna live here anymore so he got replaced by another person NOT on the lease. am i liable if my apartment complex finds out? i really dont want to personally get in trouble or face fees. thanks for any advice or tips you may have

Yes, he should be on the lease and management should know about him. I am not a landlord or knowledgeable about rules and regulations. But, from life experience (and a whole lot of viewing court TV shows ) I believe management could ask him to leave if they do not approve.

I do not know what you need to do now. This is just an idea from the TV court-viewer - maybe approach your landlord and explain new roommate has been "visiting" and would like to apply to be a resident.

Another thing, the roommate that left, if he was on the lease, is still responsible for his share of the rent and/ or any damage that is done if he is not removed from the lease. That was his responsibility to do but if the new roommate would be approved, that wouldn't matter much.

Good luck. This is a good learning lesson, and not really hard to make right, I would think (but you know about my "thinking" hahaaaa).

Thanks for your reply. i think you are right, i just thought that i would be living with the 2 other ppl but i did not know one was planning on leaving and being replaced by another person

Yes, the names on the lease are the folks who are liable. If you have any doubts at all about the new guy's willingness/ability to pay the rent and abide by the rules of the building, get him to put his name on the lease. If he damages the premises and is deemed your guest, then you are liable for the cost of damages.

The new guy is sub-leasing. Unless your lease specifically gives you the right to do this (which from my experience is VERY rare) then yes, you and everyone else named on the lease is responsible. You could sue the person not on the lease after the fact if there are issues, but that is not the landlord's problem.

Informal/undocumented agreements regarding rent rarely end well. You have no leverage if he bails without paying or damages the place. Get it in writing and demand that he be put on the lease.

It's definitely in the interests of the person who's leaving to work something out with you; since they're responsible for what happens there even after they've left, if their name's still on the lease.
