They are suppose to pay back wages, but if they go bankrupt and say that they have no money, how will the employees get their money? A temp agency did just that after the Super Bowl and I remember the company basically told them to kick rocks. I think because it was a temp agency it was easier for them to evade the law.

My previous employer was able to delay paying me back wages out of spite and not be penalized. Had I not kept a record of my hours, I'd have never seen the little bit of money I saw. She was able to remain open for business even after not paying taxes to the state/fed AND cheating her employees.
