I hope that guy gets locked up, you cant kill people, this isn't the 1850's. Protecting my family is such a BS line, if the guy had broken into the house, then I would understand, but the shooter clearly thinks its ok to murder people.

Was the homeowner 'up' at that time or did he hear the crash and investigate?
Did the deceased make noise while entering the yard? Was he spotted heading toward the house? Or, had he attempted to enter the home?

I'm often up at 3AM, but I wouldn't have a weapon in my hand unless I heard something suspicious(has never happened since we moved here). Would a vehicle crash startling me from sleep put me on alert?

What was the weapon used?

WAY too many questions to draw conclusions at this point.

Very hard to say what happened, so it is a bit pointless to speculate.

I lived in an apartment in GA many years ago, and some guy tried to break into an apartment about three doors down from me. Actually, the door was unlocked (someone had just left) and he walked right in. He was drunk/drugged (not sure what the final details were) and thought he was in another apartment block, in which case the apartment would have been his. Seemed simple enough and kind of funny, or would be if he had not then proceed to try and assault the woman that lived in the apartment. She hit him with an iron that she was using, which apparently only delayed him momentarily, but allowed her to flee the apartment. He then tried to use his key and get in the apartment next door (also occupied by a young woman). The police showed up and he refused to listen/comply with any 'requests', which eventually led to him descending the stairs rather abruptly (this was on the third floor).

Anyway, the case was he did not have any ill intent (apparently) when he started into the apartment, but he did by the time he entered. This guy in AR who wrecked was very likely under the influence of something (just by statistics - 3 a.m., single car wreck, leaving the scene) and probably not able to make good decisions. Whether he was a threat to the homeowner or not may be hard to determine, or whether he APPEARED as a threat, which he might have done (i.e. he might have thought it was his house and tried to enter).

Yeah, sounds like yazdi messed up. My guess is the 23 year old was probably intoxicated and running so he wouldn't get in trouble. I'd hate to be anyone who touched a toe on that guys yard if he's that hypersensitive about it. We had an experience where someone tried to get into our house abt. that time of night. Our dog was going ape**** and my daughter and I were scared, but my husband, instead of shooting the guy, called 911 and the cops were there in less than 5 minutes. They found the guy in my neighbors backyard hiding. Turns out it was a drunk kid who thought our house was his house and when he realized finally that it wasn't and the cops were surrounding our house, then he tried to hide next door. The cop told us he had just gotten out of jail for a DUI the week prior. My husband just laughed it off and didn't press charges and noone got hurt. We haven't had another incident so far.

I saw a comment on Facebook about the deceased being nude and laying on the sidewalk. If that's true, then there definitely is more to the story than a simple case of misunderstanding and being trigger happy.
