Residential.

ours is appraised up 19% from last year for this year .

The amount of increase doesn't matter. It's simply whether or not it's appraised too high. You don't use lawyers for a property tax protest, you can do it yourself. Get a local Realtor in your neighborhood to run a CMA for you to determine the value as of Jan 1, 2009.

But the deadline to file has past unless it's been less than 30 days since you received the notice of appraised value.

Yes, it's appraised too high compared to our last March refinancing appraisal.

Steve,
We went through the informal and was told to get some pictures of the comps when they were listed (bath, kitchen, etc.) Our realtor for purchasing the house drags her feet on getting anything to us. If we contact a new realtor, what would be our obligations or he/she will just charge a fee to go through some old docs?

I have not worked with them but this attorneys website has lots of good information on protesting your appraisal.

If its a homestead texas state law doesnt allow a increase over 10%. Did you increase the foot print of the house?

Well, TCAD doesn't have pictures of their comps, so I don't see how they can require them. I've never heard of that.

If you contact a new Realtor, you have no obligations. They can either agree to do you a favor or not. You might get added to a newsletter list or something though.

Is this your homestead? If so, they can't legally raise the tax appraisal over 10% in any given year. If it's not your homestead, all bets are off.

I've not been asked to provide photos of comps the times that I've protested (successfully - keeping my fingers crossed the upcoming protest will go as smoothly). But I've not gone through the entire process - got it changed at the informal first meeting.

I did have plenty of photos of the subject property, however.
