I was read ended today morning in my 2012 Honda Civic LX on the I-45 in Houston Texas. I heard a loud bang and that is it, my vehicle went out of control and had hard time to control it. It was a very hard hit and car spinned out of control and my car ended up in the grass between I-45 and the next road. I was completely disoriented for few minutes. I regained my composure and searched for my spectacles and identified it after few mins and then came out of the car. I was really lucky today to be alive. I could not identify what happened and luckily a witness stopped his car and tried to help us. I went over and found the other car which rear-ended me on the other side. The insurance company of the car which rearended me just accepted their liability and requested to release the car from storage. They asked me if i have any injuries. I said that i do not have any visible injury, but my neck started paining. They have also agreed to setup a medical checkup. Please find the picture of my car which was rearended and also the picture of the car which rearended me. What are my options with the insurance? Request your esteemed guidance. I had maintained my car really well and was consistently managing to get very good mileage (46 mpg avg) by not stressing the car.

Since there are injuries I strongly suggest you get a lawyer involved. The other party's insurance company is NOT your friend. Injuries can have long lasting consequences. Get a real lawyer not a ambulance chaser. But stop talking to them and get someone who is on your side. You have no idea what can be wrong with you medically speaking. You need to get someone who knows how to navigate the vehicle accident/insurance co issue.

That thing was creamed. It's most likely totaled. Big impact

Wow they hit you hard.
I would also recommend that you get a good lawyer involved. The last poster is right THEIR insurance company is not your friend and in some cases YOUR insurance might not be so friendly either. It is sad but you need to be your own advocate and having an attorney on your side really helps.

Excellent advice...! There are many extenuating variables however many injuries do not surface immediately. I would almost bet you feel worse today than you did the day of the collision.

I am no fan of the typical "ambulance chaser", however you will most definitely need competent legal counsel. Many of those "TV attorneys" look for the fast, uncomplicated settlement, some never step foot in a court room....beware !

If the photos are accurate, you are very lucky to be walking and talking today...the car appears a "total loss"...however...cars can be replaced..you can't !

I would advise you to immediately seek both competent legal and medical advice...cease communication with the opposing insurance carrier and limit your discussion. Best of luck...

Since none of the other posts mentioned it, DO NOT allow the other party's insurance company to "set up" a medical appointment for you, as that appointment would be with a doctor of their choosing, who is paid to find nothing wrong with you. You need to go to a doctor of your choosing.

If you don't know of an orthopedic specialist, ask your GP for a recommendation, or ask friends, neighbors, relatives, and co-workers for a recommended orthopedist. You want an MD who is unbiased, and--unfortunately--that word does not describe a doctor who is being paid by the other party's insurance company.

Bingo. He needs to select his own physician who is totally independent of the insurance company.

I happen to be an attorney myself. The other posters are right that you should contact and retain an accident attorney in Texas. The sooner the better. Here's some advice for picking a lawyer. If they advertise on t.v. than you don't want that attorney. Instead, get recommendations from friends, your local bank branch manager, and your insurance agent.

Try to avoid giving additional statements to the other driver's insurance company. They frequently try to trick you and get you to say things that come back later to haunt you.

Don't let the insurance company direct you. Its your right to make your own decisions as to who treats you, how much treatment you have, and where your car is repaired.

Thanks for all your advice and i agree with all your comments.. I will try to get myself assessed at my independent medical checkup may be a day later by understanding how the pain develops.

Hope you all would have seen my rearended car. The car from my perspective has a very very major damage. I am not sure if the insurance will try to save money by suggesting to repair the car instead of totalling the car. Any suggestions on this are also welcome.

Your car will be repaired. It's not that big of a hit, and there's nothing major back there, just some suspension and sheet metal.

The other guy will be a total most likely because there will be engine damage.

Go to your insurance agent immediately and to your physician, do NOT talk to anyone else.
