My wife and I were divorced in the state of Florida where I lived and she lived in NY. The filing was done in Florida with the child support being an agreed to value. I unfortunately just lost my job with a major corporation and will have to file bankruptcy. This will crush me financially but I have no other choice due to the economics.

I will not be able to pay the agreed to value in child support with no job but will try to work something out with my ex wife. I have moved back to NY form Florida and when I find another job it will not pay as much as my previous one. Can I get the child support amount lowered based upon my wages whatever they may be? I am in a state of shock now and I want to help take care of my kids but I can't at the level of before. Any advise someone can provide would be appreciated.

call your attorney, I would think you would be able to get some solid advice from him or her, I would think they would adjust it.

Good Luck!

You'll have to get in touch with someone in family court where you live now (in NY). You might be able to get your child support reduced, or the account will be noted with the Support Collection Unit (NYS) of a delay in payments. The best advice, go through family court.... have everything documented before speaking with the SCU. In the mean time, don't hold out for a job like you had, take what work you can find to lessen the delay in payments. The SCU is very strict in NY. Wishing you good luck, let us know how it all works out.
