I had a restaurant from 1989 - 2009. It didn't make it through the recession. The NJ state labor department (NOT the state tax division) has sued my company claiming that I owe them money related to unemployment from 2007-2009. I was not aware of this until now and I had been extremely diligent in paying with everything I owe to the state the entire 20 years I owned the business (at least to my understanding).

Of course I plan on discussing this with the state and my accountant. But I have general questions that maybe someone here can help me with.

Will the judgment affect my personal credit?
Since the company is defunct (no revenue since 2009, no assets to its name), will I be liable for anything owed?
Will this affect my ability to open a new restaurant down the road if I am once again in the position to do so?

Details: Company was LLC and was in business for 20 years without any tax or labor department issues before. I owned 90%, my dad owned 10%. There is no revenue, no assets, and no employees.

for not paying rates while operating...?
or for not making quarterly reports (even after closing or not informing)?

How did you not know about it until after the judgement? The state will always win if you don't show up in court.

Chef,
your employees went to the state of NJ and filed for unemployment during
those 2 years.
They received some monies, that is why the state pursued it.
If they pay out on an employee, they want their money. That's how it
work.
You did hear something, you were in denial.
They send out the letter asking why you laid them off, they don't
pay out without a response.
Just pay it, now.
Call them, ask for the names of the people who collected, and pay it
as soon as you can.
Tell them it is no longer in business, arrange a payment plan.
You will pay more penalities than it is worth if you don't.
Can they go after you? YES
Can it keep you from starting a new business? YES
Clean it up.
