Can you help?

Regular CA UI claim started 2/28/10, ended 7/5/10 (due to my exhaustion of avail bene's).

Denied EUC benefits, due to me not meeting eligibility req's by $800 in wages or so.

Knew I made more than what my employer reported for the claim period so appealed in front of judge, denied since I had no proof to show him addt'l wages. Still puzzled...located a seperate, W2 from 2010 which is '3rd Party Sick Pay'. Again, I only had one employer, but my employer paid me sick pay through a 3rd party.

I appealed by writing about 1 month ago. Lead time is 6-8wks for review. I have a mortgage and can't find work. Do you know by chance if 3rd Party Sick pay is considered WAGES for EUC eligibility?

Looking for some hope and the wait time is making me anxious. Thank you. Sorry so long.

If it's on a W2, it's generally wages. Not a lawyer, but that may be something worth fighting over in my layman's opinion if it comes down to it

My read of the code is that, as long as you had 20 weeks of full time employment during the year ending 2/28/10, EUC is basically supposed to follow the state rules. If you're eligible for state unemployment insurance, you should be eligible for EUC.

However, that is a moot point (for now) because the EUC program expired as of November 30 and there's no more money available, unless the Congress votes to extend it.
