While my search for a place to move seems to lead me closer and closer to home, I've started looking into west virginia. The Charleston and outlying areas particularly. But while reading some older posts, I noticed that someone wrote that in the state of WV, they can actually take children AWAY from their gay parents and place them in foster care. Even if one is a biological parent.
Please, someone give me some laws here telling me this isn't true. Can they use sexual orientation to determine how fit you are as a parent and use it as a basis to investigate you and place your kids in foster care???
Well, no one on here can dispense legal advice. However, in my opinion, I've never heard of any State removing a child from a biological parent just because they were gay. I'm sure there are cases where a disgruntled ex spouse of someone who is gay tries to show they are unfit to be the custodial parent or something, though. Family arguments, etc., might use that as fuel for a case. There ARE states however (such as Florida) that ban gay people from adopting kids, etc.
You really should just look up an attorney or two via the web who's located in WV and call them to ask. I'm sure some would answer the question for you quickly on the phone.
Considering the courts just ruled that they couldn't remove a foster child from a lesbian couple simply because they were a lesbian couple I really don't think what you've heard is true regarding biological children.

If the children are biologically yours or the adoption process has been some time ago it would be very difficult. There have been a few issues in some of the more rural & conservative counties, one in particular where a local judge ordered a child in foster care with two lesbians be removed. Thankfully that issued was settled at the state level in favor of the gay couple.
