My wife just got laid off from her job. Due to her age and length of service, she was able to take early retirement and draw a (reduced) pension.

I searched the NC Employment Security Commission's website but could not find any rules/regulations about applying for unemployment benefits while drawing a pension. Has anybody here been in such a situation, and if yes, can you let us know what you found? Thanks in advance.

I'm almost sure that you can't collect unemployment if you're "retired". If you're collecting unemployment you're supposed to be actively seeking work. If you're retired you're no longer in the "unemployed" pool.

I've never been in this situation, but know people that have. Retired is retired. Also, if she tried getting unemployment, her employers would contest it since she's now drawing on her retirement pension fund. If by pension you mean Social Security then it would also be the same thing. You can't double dip.

Depending on her age I would consider finding something else to work in and holding off on collecting social security -- if she's of age to. The amount of money you can collect at 62 vs. 67 is a huge difference.

^Many employers which still offer pensions will make a laid off employee immediately take their vested pension or delay receiving it for a set # of years. Receiving that pension doesn't mean you are retired and it doesn't make you ineligible for unemployment benefits. You can still apply.

However what they will do is to subtract the monthly pension income from whatever unemployment benefits that you are deserved. In most cases that will eliminate it.

Every situation is different. You can always apply for benefits. There is nothing wrong with that.
