I live and work in NC. I was laid off from a job on 5 Oct 08. I have been drawing unemployment since then. I started a job (through a temp service) this tuesday only to find out that I was deicieved about the job. Everybody there was all temps and and when their time came to be hired by the company, they would not hire them perminately, they were letting people go, only to hire more temps. I had mentioned to another employee about other jobs I was looking for and told him he should look into as well, after all, he and multiple others agreed with my observation. They never told us this at the temp firm. Word got around and they let me go after my seccond day. My question is, what should I do my unemployment benifets? From what I understand, it is illeagle to claim benifets if you have worked during that week. I also hear that if you get terminated, you cannot draw.

What should I do?

You CAN draw unemployment after being terminated. Your weeks unemployment benefits for the week that you worked one day will be reduced, but, you can get full benefits from the weeks going forward. check out the NC unemployment website.

Did the temp service charge a fee? If yes, maybe that's where you should look for recompense? ie: fee paid less than wages earned with temp service and employer in cahoots.

It is possible to get your benefits re-instated but the Unemployment Commission may make you jump through a few hoops first.

I was offered a job that sounded similar to my previous one on paper but in reality, was very different. My skill set did not fit with the new job even though the employer claimed it did. Turns out they had difficulty finding folks to fill the job and would tell candidates anything to get them in the door. VERY high turnover rate. I resigned.

Anyhow, the Unemployment Commission had me fill out a questionaire and they contacted the employer to verify the information I gave and within a few weeks, the benefits were re-instated.

Also, in the event that the Commission denys your claim for benefits, you do have the right to appeal the decision. I know folks who have and were successful.

Usually a temp. service hires people on a temporary basis. Were you guaranteed in writing that you would be employed there for a minimum time period? If not, you are just unfortunate in that respect. As far as unemployment. You can still claim or get reinstated. The amount that you made for that particular week will be deducted from your weekly check amount. I don't know how it is in NC, but in FL if you are receiving unemployment and work, you can claim that amount for the week, if it less than your employment benefits, you will get the difference and continue on as before. If you haven't filled out anything for them that said that you had permanent work, you should be o.k.
