I feel like my situation is a bit complicated. The carpet needs to be replaced because of pet stains but he would have had to replace it anyway because of flooding issues. I lived on the first floor of a 12 story condo building. The kitchen sink would back up quite often and a few times flooded the entire kitchen which soaked the dining room and living room carpet. The bathroom flooded once and it soaked the carpet in the hallway and even went through the wall into the bedroom closet and soaked the carpet in there too. When the bathroom flooded it was at night and they had to shut the water off until the next day which meant i couldn't use the toilet or shower or sink so I went to a hotel which I paid for myself because I needed a toilet and shower. I feel the unit was unlivable because of all the flooding caused mold. There was a leak under the kitchen sink which constantly dripped which caused a couple inches of water to form. I have pictures and videos of all this, and the office in the building has record of having to come fix the sink multiple times. My landlord is now saying he probably won't be giving me back my security deposit because of the pet stains. He had to replace the carpet about a year and a half ago as well because it flooded and there was mold growing, which his insurance covered. Also, if he doesn't give it back or send me a letter and itemized list of damages "caused by me" within the 30 days that was in the lease, can he even keep any of it? I lived in Schaumburg Illinois. I was also charged a pet rent of $20 or $25 a month, would that money cover pet damage?

The pet fee covers additional "normal wear and tear" not damage caused by pets.

He needs to send you an itemized list of damages he is deducting. If he does not or you disagree that you caused or wish to argue it is normal wear and tear then you can go to small claims court.

In general, I've found do not expect to get your security deposit back unless you fight for it. I left a place spotless and their incompetent bookkeeper put down I didn't pay rent and sicked a collections agency. After I produced canceled checks and began the process of suing they finally caved in and gave it back otherwise where I was I could sue for triple the security deposit.

The whole in the drywall, the damaged cabinets, any damage and I usually take the cost for repairs. I do repairs myself. I don't rape tenants for leaving. Itemized list for cost. Use
