I was recently in a car accident where I was in the right lane turning right at an intersection and a driver in the lane next to me (on my immediate left) illegally turned right (he was supposed to go straight through the intersection) and hit my car. He was cited by the police for making an illegal right turn from a center lane. His insurance company is refusing to pay for the damage because they said I " failed to yield the right of way and caused the collision." So, I would like to attend his traffic hearing to if he is charged (which would help my case with his insurance company. So:

1. Can I attend the traffic hearing?
2. If yes, will I be allowed to speak (I know it's up to the police officer who cited him, but he may or may not show up)?
3. If the answers to 1. and 2. are no, how do I find out if he actually gets charged for making the illegal turn or if the charges are dropped?

I was in an accident back in 2012 where I was rear ended while trying to get onto lakeshore drive near mccormick place. that said, the guy who hit me had subpar insurance that REFUSED to pay despite me getting rear ended. I had to pay my own deductible out of pocket. GEICO tried to take him to court and they couldn't find him for a couple years. once he was finally served, we went to court in 2016 and he didn't show so I won the case. then after that, it still took another 5 months before his insurance company FINALLY paid that claim out.

when I went to the hearing, I basically had to testify about what happened and that was pretty much it.

I went to traffic court along with my mother when a guy who decided the red light was discretionary slammed into us while we were making a left turn.

The guy tried to claim it wasn't red despite both the cop (witness statements) and us testifying otherwise and the judge after rolling his eyes just gave him the same fine as if he plead guilty.

Insurance was never able to collect but State Farm is not very aggressive about going after money for small and moderate sums (~$2k in damages to her). Fortunately she has an insanely low deductible ($50 very old policy).

Having the other driver cited does help win the judgement if you need to go to court or fight with insurance.
