Personally I agree that the "probably" usage was an act of marketing to appeal to people more than just saying it is or it isn't. They are admitting there is no proof either way and that they are leaning towards the NOT side.
I don't see the use of "probably" as a sign of them doubting their position or being unsure. I see it as more of a sign of openness that they are open to proof either way, but that they personally don't see it as it stands right now.
