“The daddy apologized about a dozen times that he was sorry it happened and the boy said he was sorry. That’s about all he said,” victim Steven Fields said.

Both the victim and the man convicted have the same name and both live in Hull, a small town in Madison County. They never knew one another even though for a time they lived on the same street.

The 70-year-old deposited more than $30,000 in his checking account after he sold land.

The bank teller, who he has known for years, mistakenly deposited the money into the 18-year-old’s account.

Because regardless of who screwed up, the money was not his. Clearly he knew he did not have $30k and only "mistakenly" spent it thinking it was really his money. He effectively stole $30,000.

From a moral, ethical standpoint, he shouldn't have spent it. However, it should really only be the bank's responsibility.

I agree, but it is a fact that banks have never (and never will) accept responsibility for their mistakes.
Many years ago, a bank processed a check twice. Since it was the ONLY check that month with that dollar amount, it was easy to see it had happened. The bank flatly stated it was impossible, it could not happen, the mistake was mine. After I proved to them that it certainly DID happen, and they returned the money to the account, they STILL insisted they did nothing wrong, and when they were able to prove it I would have to give the money back to them. I changed banks, and let the account sit idle for six months, then closed it out.
They never did accept responsibility for what happened.

So if somebody mistakenly deposited $1,000,000 dollars into your account you should be able to spend it as you wish? This is stupid. Of course the bank made a mistake, but this person knew he didn't have that kind of money in his account. Is this the new age thinking? It was their fault not mine. I am not held responsible for my actions EVEN though I knew the money wasn't mine. What a load of BS.

I definitely feel he should be ordered to pay it back.
10 years probation seems a bit harsh, though.

I agree it should be more like 10 years jail, hey he knew better to begin with.

That's like saying you got the wrong order at a restaurant after eating it all anyway, then asking for your money back because they prepared it wrong.

Ummmm, no. It's your own fault. Even if they did make it wrong, you still ate it.
