I'm not defending his carelessness, I just wouldn't call this a crime unless intentional.

From the article:

"The news release says a student went to the teacher's desk to ask a question and saw a face-up iPhone with a website showing adult male pornography. Three other students saw it and reported it to school officials.

Velez-Gonzalez is charged with four counts of showing obscene material to a minor."

I doubt the charges will stick, as the teacher did not "show" the students the iPhone or the porn. They saw it, yes, but that is not the same thing as the teacher showed it to them - intent matters in this case/with these charges.

Stupid move on the teachers part, and I would question whether he is responsible enough in his behaviors/choices to be a teacher, but I am not sure a criminal offense took place here.

If I were the principal (and the union or tenure didn't hamstring my options), I doubt I would renew the teaching contract with this individual, but that is really where it ends - criminal charges? No. I don't see them as valid.

Teacher was an idiot for looking at porn on his phone during school hours, hours that he's on duty, so to speak. If this had been 30 years ago and a teacher had left a copy of Penthouse or Maxim on his desk, you better believe that it would have been cause for dismissal. Why would you bring that stuff to SCHOOL? Stupid, stupid, stupid!

Here's another piece of the puzzle from Brietbart:

"Three other students reported seeing their teacher watching porn and took pictures and video of him doing so. The school district placed Velez-Gonzalez on leave Friday, and he was arrested the following Monday."

So, not only is his stupid, he's terminally stupid, to keep watching the porn WHILE IN CLASS.

Maybe he should have called in a resource officer to take care of the kids who had their cell phones out videoing him. :-)

And, from the Daly Mail:

"One of the students supposedly approached Velez-Gonzalez's desk and said they saw the porn on the teacher's cell phone, WFLA reported. The youngster returned to her seat, but then went back up to the desk because 'she could not believe what she saw.'Investigators say she then used her phone to record the images showing up on Valez-Gonzalez's device.

Three other students reportedly saw the same images and reported him to the police.
Police then searched Velez-Gonzalez’s phone, and found he visited 'hook-up' site adam4adam.com nearly 400 times during a two-week period. Two of those times were allegedly during school hours."


I found this account more interesting -- the girl was "so disgusted" that she went BACK to look at it (presumably bringing friends with her), and stood there to record it on HER phone . . . um, what?

Still - stupid teacher.

This guy just got caught that's all. With 4g cellular networks everywhere you'd have to be really naive not to think that ALOT of porn watching goes down at school. Not that all teachers are bad but I'd go out on a limb and say that at least one teacher per school who occasionally pulls up some porn on his smartphone.... They are just more careful not to get caught!
