Yeah it sounds like an ex issue. The ex knew the phone wasn't his but he wanted to punish his ex instead of finding out why she took the phone away. If you have kids, no matter how bad you hate your ex, you need to try and get along and not call cops for stupid stuff.

They also shouldn’t be undermining each other’s discipline. It sounds like when she gets punished, she runs to dad and complains, and he intervenes on her behalf aggressively.

Really. This should have been resolved outside of court even if she WAS guilty of outright theft of a cell phone worth less than $200. Who wants to foot the bill for a court trial in that case?
