Default Looks Like Punkin' Chunkin' Will Not Be Returning to Sussex County

Cape Gazette article indicates that a bill capping damages from injury or wrongful death at $1 million did not make it out of the Senate Executive Committee, essentially keeping events such as Punkin' Chunkin' out of Sussex County and perhaps even the state in the future (the event is being held at Dover Downs this year).

I never had the chance to attend, but it was high on my To Do List once I moved to Sussex County. Without knowing the full story of the volunteer who was injured and sued the farm owner, thus leading to the farmer's withdrawal of use of his property for the event in Sussex County, this still strikes me as sad.

According to the article the event drew lots of business to the area in the slower season, raised lots of money for charity, and was basically a fun event that drew national attention.

I'm always cynical when I hear that an initiative fails because the "Trial Lawyers' Association" opposes it. That might be unfair, but I hope there is more to it than the lawyers not wanting to waive their ability to collect unlimited amounts if an accident occurs. My leaning has always been anti-litigious, as I think life in general has inherent risks and we shouldn't legislate away all the fun. Short of folks sending their kids running through the field trying to dodge flying pumpkins, seems that there should be a way to make this as safe as say watching fireworks!
