I am really curious. Say you were having a home built in a brand new subdivision in Kent Co DE, would u still have a tittle search completed? No one's owned the home before u and the subdivision is brand new. My sister says anyone in there right state of mind would have the tittle searched for the previous ownership of the lot. My position is if there was a problem with the tittle of the land in the subdivision there would be no other homeowners. Please weigh in and give us your opinion.

Comparing the costs of Title Searches and Surveys to the cost of dealing with possible later problems I would certainly spend the fewer bucks .

There are only 38 lots in my subdivision and I am scheduled to go to settlement in February. Only three lots left. No one else that I've met had any tittle issues.

Your lender doesn't require that you obtain a Title Search on the property?

It's probably more important to have a title search and a title insurance policy on new construction. If a subcontractor doesn't get paid by the builder, they could put a lien on the property. Ideally, you should have had a clause in your purchase agreement requiring title insurance.

The land was owned by someone before and before that...all the way back into the 1600's.
If there is a lien against the land, the title search will find it and if not, protects if one is ever filed or later discovered.
