Colorado man arrested for openly carrying gun in movie theater | The Lookout - Yahoo! News

On Sunday night, Thorton, Colo., police arrested James G. Mapes for openly carrying a holstered firearm into a movie theater, according to the Denver Post. The Thornton theater where the arrest took place is only 25 minutes away from the Aurora theater where James Holmes went on a shooting spree killing 12 people and injuring 58; both cinemas are situated in the Denver metropolitan area.

"It shall be unlawful for any person to knowingly possess on or about the person or within such person's immediate reach any dangerous weapon."

So does that mean you can't CCW in Thornton if you are in arms reach of anyone?

I'm not certain as to Colorado law in this area, but this theater doubles as a bar.

It seems that other than the city/county of Denver, Colorado's gun laws aren't as strict as some states. The laws vary between jurisdictions.

Open carry is not legal in Denver County.(last time I checked anyway) Even if it it was, that wasn't a very smart move on his part, given what just happened.

I know this doesn't seem to be the issue, but I have a question for knowledgeable gun advocates.

Would it matter if the theater decided the man could not carry a gun on their premises? i.e., would private property law override 2nd amendment rights (which are more about government "shall not infringe").

No, no law overrides the right to keep and bear arms. The problem is, not many people have the time and money to challenge an un-constitutional law all the way to the Supreme Court. The NRA can, but they have to choose their battles carefully. One bad decision from the iffy Supreme Court would set back gun rights for a long time, maybe for good. That is one reason the up-coming Presidential election is so important: the next President will likely appoint at least one Supreme Court Justice during his term. Obama will appoint an anti-gun Justice.

This happened in Thornton (either Adams or Weld county) - not Denver.
