Hello, I need to file an amended 1040 return for Tax Yr 2010. I had received a six-month extension in April 2011 and filed my return on 10/17/2011 (Oct 15 was a Saturday). The documentation states that the amended return needs to be filed with three years. Do I need to file it by 10/15/2014 or do I have the extra two days until 10/17/2014, which will be three calendar years after filing? I really need those two days, I am too tired to continue tonight and I would need to take tomorrow off otherwise. (Yes, I am a terrible procrastinator, but I swear this is the last time. Really.)

Maybe you'll get to pay a penalty?

Wait. THREE years???

If you have to pay the penalty you deserve it. If they will even accept it.

The tax code says three years from the date you filed your original return. If you filed on 10/17/11, you have until 10/17/14.

I did this once. I discovered a clause in my state tax code about medical expenses that I hadn't known about and that entitled me to a refund of a few hundred dollars each of the prior 3 years, so I filed amendments for all 3 years and got the money back in a few weeks. It was worth it. Good luck.

Just be careful, after 3 years they keep the refund due........If you owe them of course you still owe but if they owe you then you lose!
