He can grant waivers to the states by executive order, which is what he will do. then he will work to legislatively repeal it. The point of the executive order is to find a fast temporary solution on the first day as a legislative repeal would take a while

99.9% of all promises made by anyone running for POTUS were promises that could only be delivered if the US Congress cooperated. This is just one example.

If Mitt Romney or any future candidate makes a campaign promise, just make the assumption that legislative cooperation is implied. Otherwise, every president in living memory is guilty of exaggerating their own power to deliver on their promises, including Barack Obama.
They can also just not fund it, which has already started. It will require Congress to repeal it completely and Mitt Romney has made that clear, but he can give waivers to all of the states.
