do you believe the SCOTUS would wait till years after a national election to decide on the eligibility of a candidate from a major party?
How do you think we got stuck with Obama (who also is ineligible as an admitted dual citizen at birth, I've explained the ineligibility in detail complete with examples of how dual citizens are still to this day impacted negatively by their foreign citizenship)?
The world couldn't contain the birther howling over their certainty that it was fake. But they gave a pass to Cruz and accepted this as perfectly legitimate,...
a better example was the release of romney's birth certificate:
romney released a contemporary state issued certificate of live birth (COLB) online at the end of may 2012. it was accepted as legit and the COLB as legal proof of birth.
obama released a contemporary state issued certificate of live birth (COLB) online at the beginning of june 2012. it was claimed to be a forgery and the COLB as not legal proof of birth.
identical actions and identical times in their respective campaigns with completely opposite outcomes.

ankeny v daniels directly states differently:
"Based upon the language of Article II, Section 1, Clause 4 and the guidance provided by Wong Kim Ark, we conclude that persons born within the borders of the United States are “natural born Citizens” for Article II, Section 1 purposes, regardless of the citizenship of their parents."
A state court? Opining on Federal Government office Constitutional eligibility? Not a precedent. Furthermore, the decision quoted WKA incorrectly. SCOTUS never ruled that WKA was a natural born citizen. He was ruled a citizen only.
yep, and the birthers had the chance to take it to the SCOTUS ( and i wish they would have ) but..... they dropped the ball.
Apparently, SCOTUS is under the impression that U.S. citizens have no standing to question the eligibility of their elected leader. Really? As if what a POTUS does has no effect on U.S. citizens whatsoever?
SCOTUS punted when they SHOULD have ruled on this. A lot of people lost confidence in our federal government and judicial systems over this.
I've followed birtherism long enough to know all of this. The problem birthers have is that the term "natural born citizen" was never defined in the Constitution. What we do have to go by is case law. And going by established case law, Cruz is a natural born citizen by virtue of his American mother.
The same principle applied to Obama.
It's a fine point of law that Internet attorneys can't seem to grasp.
“As a legal matter, the question is quite straightforward and settled law that the child of a U.S. citizen born abroad is a natural born citizen. People will continue to make political noise about it but as a legal matter it is quite straightforward.”
