He could only take it to court if he were denied being either put on a ballot due to not being eligible or by not being appointed to office following an election victory. Neither has happened that I'm aware.

It seems to be unsettled. There is a moving line on who is or isn't "natural born" so we need a supreme court decision or a constitutional amendment to pin it down. There are arguments either way but the constitution leaves us guessing. When George Romney was trying to gain the GOP nomination decades ago the issue surfaced for a while because he was born in Mexico but it faded away once he lost the nomination to Nixon. Also, John McCain was actually born in Panama on a military base. Since Cruz was born in Canada and his parents were apparently registered voters there we are left wondering. It would be nice to get this put to bed one way or another.

A Natural Born Canadian would be one born in a Canadian province whose father was a Canadian citizen at the time of birth.
