"According to the affidavit by an investigator with the department, an unauthorized individual illegally accessed a state government emergency management system to send a group text message to government officials last month urging them to speak out about the coronavirus crisis. "It's time to speak up before another 17,000 people are dead," the message said, according to the affidavit. "You know this is wrong. You don't have to be part of this. Be a hero. Speak out before it's too late." Officials traced the message, which was sent on the afternoon of November 10 to about 1,750 recipients, to an IP address connected to Jones' house, the investigator wrote in the affidavit."

""FDLE began an investigation November 10, 2020, after receiving a complaint from the Department of Health (DOH) regarding unauthorized access to a Department of Health messaging system which is part of an emergency alert system, to be used for emergencies only,"

"An unidentified subject gained access to the system and sent out a group text saying: "It's time to speak up before another 17,000 people are dead. You know this is wrong. You don't have to be a part of this. Be a hero. Speak out before it's too late."

The text message was sent from the ESF-8 mail account to 1,750 recipients before the software vendor could stop the message from being transmitted further, the affidavit said."

"The ESF-8 account is the state's emergency support function for public health and medical services and is used by many people from several agencies, including DOH and Emergency Management."

"The FDLE investigator claims he determined through his "investigative resources" that an Internet Protocol, or IP, address associated with Jones's Comcast account was the source of the ESF-8 text message."

"Florida state laws increase the offense to a second degree felony penalized by a term of imprisonment of up to fifteen years and a fine in of up to $10,000, or both. This sentence also holds true if the results of the hack hampered or interrupted state governmental operations or public services"

Except, it didn't hamper or interrupt operations or services. It actually enhanced them, because it provided the public with information they should have been provided, but weren't.

You are playing games because you can't just admit you are wrong. At this point, I'm not going to engage anymore with you.
Precisely my point.

There were two problems with earlier postings here, it's not important who was responsible for inflating them. First - that citing a federal law had anything to do with Florida law in the same realm and, second - that the argument about defining the term "hacking" had anything to do with the law at all.

She amplified false information, thereby inciting public panic during a tense public health crisis.

Data scientists is a computer expert.

You cannot be a data scientist with being very good with math, SQL, AND very good with a programming language, usually in Python.

Yes I can do all that too but I'm not a computer expert. I don't know much about networking or the "internet of things." In order to be a COMPUTER hacker, you have to know how those kinds of things work. You don't need to know how those things work, in order to be a data scientist. You just have to be really good at collecting, categorizing, sorting, analyzing, and translating data.

guys, you're confusing the definition of "hacking"

The state will usually pursue criminal hacking charges of these types under the Florida Computer Crimes Act although computer crimes are hardly ever limited to a particular locality. Because of this probability, many hacking cases are prosecuted by the federal government. Florida's computer related crime laws can be read by following this link.

In Florida a conviction for hacking as well as other cybercrimes are prosecuted as a third degree felony punishable by up to five years in prison as well as a fine of up to $5,000, or both. If the illegal activity creates in excess of $5,000 in damage, Florida state laws increase the offense to a second degree felony penalized by a term of imprisonment of up to fifteen years and a fine in of up to $10,000, or both. This sentence also holds true if the results of the hack hampered or interrupted state governmental operations or public services, or is perpetrated in a scheme to commit fraud or theft. In a case where it can be proved that human life was endangered, the violation is raised to a first degree felony, punishable by a term of up to thirty years in prison and a fine of up to $10,000, or both."

She hasn't been charged with ANYTHING for this situation. They came in, took her equipment, and left. No charges filed.

She's suing to get the stuff back.

uh, that post was mostly for your benefit.....you are the one arguing she has to be some computer expert to hack...or to even be charged with hacking

that's not the legal definition of hacking........

>"However, unauthorized use of another person's email account or other unapproved access of another individual or personal or company computer may lead to a computer hacking charge if the person or entity chooses to file criminal charges."

...which is exactly what she did

and no, I didn't say she was charged with anything...but you know that...you just keep moving the goal post
