It's not intended as a pre-emptive strike against receiving a gift. It's a pre-emptive strike against waste. I don't see how that's a bad thing, for the customer OR the restaurant.
Yes, thank you, these are the precise issues! It's wasted food plus wasted time and effort on their part to cook the dish - and they give a full sized portion, not just a sampler. And it's when I get there and they hand me the packed and stapled shut bag and say "oh, we gave you cheese wontons for free!" not something that gets mentioned ahead of time.

If you have to, open up the bag like you're checking to make sure it's all in there, and if you see any extras ask them to remove it (acknowledging the gesture, of course), and re-staple it. I hate for food to go to waste, so I'd speak up.
Where are all these Chinese restaurants that give free food? The ones around here don't do that. Dang.

Haha, yeah, I can see that happening. I know asking them to take it out seems like a rude thing to do, but I wouldn't want to touch it so that they can offer it to the next person. Or I might even ask anyone in the restaurant if they'd like it. Not that I'd be in that position; I'm pretty sure we'd eat what's given to us.
