our NJ home is being foreclosed on and I'm looking for legal representation......what kind of lawyer would we use.........thanks

Most lawyers are part of the system...it will be difficult...find a legal clinic - that represents poor people...some activist types and let them smack around and irritate the established system...This taking of private property and blaming the victim..(home owner)...are illegal in the fact that a system based in illegality and corruption brought about the tail end of this mess...You might not win...but at least you can draw some blood as you are going down...Why should the people who behaved in a criminal manner continue to prosper and YOU...fail and fall.....and lose your home.

It is time that the courts showed some grace and allowed the victims of this massive fraud to recover...The bank will survive with out your payment...It has to be explained to the bank..that it is better for them to get partial payments than none at all...that would be good business...

You may have another problem...the vultures that are connected to the banks..who profit....find out who is going to make money on your home if you are forced out...There is probably a second party waiting in the wings....ONCE you understand the system...you can deal with them....There is no shame in being harmed by shameless people...find a young lawyer who wants to take a bite out of the big boys.

Sometimes Legal Services can help. Contact your local legal service and ask to speak with someone in the foreclosure department. You will have to be screened to see if you qualify but they can work wonders. Just a thought, are you able to keep your mortgage current IF someone can pull it out of foreclosure for you? You don't have to respond here, just ask yourself that question. Good luck.

You might call the attorney you used for closing on the house. If you used an attorney to prepare a will, they might handle this. A simple google search for foreclosure attorney's offers lots of options. Bankruptcy attorney's often handle this type of transaction as well. Depending on where in NJ you are, I might be able to offer a name.

This is a most bizarre response. First, you assume the OP is poor, though he never said anything of the sort. He might be, but we have no idea. Second, You rant about the taking of private property. This is not that. A foreclosure usually occurs because the homeowner stopped paying back money they borrowed from someone else. How do you see that person as a victim?
They borrowed money & agreed to pay it back under a set schedule. Failing that, they knew in advance that they would lose the property they offered up as collateral.

Based on the serious problems with the mortgage system, including widespread fraud by banks and mortgage companies, foreclosure defense has become a real legal specialty. It is important to find an attorney who specializes in this area to get the best chance of success.

For instance, you may be aware of the problem of robo-signers, which have enabled banks without a legally cognizable interest in the mortgage to commence foreclosures against unsuspecting borrowers.

In response to this situation you may have the opportunity to either defend the foreclosure completely or to enter into some form of mediation that may present you with a potentially more favorable outcome, but this will depend on many things, including the expertise of your attorney.

Your local Legal Services program is an excellent place to start, regardless of whether you are eligible for their services. Failing that, either your real estate attorney or the local bar association referral service may have some referras for you for attorneys who specialize in foreclosure defense.

What do you hope to do? Contest the foreclosure? Get more time? Are you charging the lender with unfair/illegal business practices? I assume you've talked with the lender about trying to get lower payments or get more time, etc. even go into short sale process. I imagine any reputable lawyer would tell you to do that first. The lenders lose if it goes into foreclosure. There are certainly lots of real estate lawyers around. Title companies should have names. Even realtors. And there are other sources, as well. This from one Web site:

"Most county bar associations provide a lawyer referral service. A contact list can be found at njsba.com/lawyer_referral/. You want lawyers who regularly handle residential real estate transactions, not attorneys who dabble in it.

How to check them out
The state Office of Attorney Ethics maintains a list of lawyers who've been disciplined for ethics violations. Call (609) 530-4008 or visit the website (judiciary.state. nj.us/oae/index.htm)."

Above note on getting a lawyer who's actually done foreclosure cases seems a good one. You may also want to contact an expert in finances and credit, to see if there's any way to minimize the negative effects on your credit.
