Hello hope someone can help me I live in Georgia, I was currently working at a Beauty Supply Store been there 6 yrs, this year in May I was injured in a car accident! Hurt my neck and back! Informed employer, Almost a month later he was asking when could I come to work, even though I was still in pain I asked my doctor she told me to try Light duty! My boss and I exchange text I told him I could try Light duty limited hours and work! He agreed I worked 2 days in pain! The second day he released me with a notice stating If I can come to work without limitation or restrictions to let them know! I am currently under the doctor care my knee is given problems from the accident! 2weeks later my boss text me after he given me the notice, asking could i work the weekends hours! I responded letting him know that I have a pinched nerve in my back I was in pain! Sorry I can't help you out! He responded OK no problem! Weeks later I go and apply for unemployment Benefits! Here's where the problem starts he is saying I refused work but I still injured and under doctors care! He is Korean and he doesn't want me to get unemployment so he appealed! He sent in text messages when is fine because they all mentioned my injures! He is trying to use my text messages against me I need help! What can I do to win I need this unemployment! He also stated I can come back to work I will never work for a lowdown Korean again! 6 yrs and I get this working when everyone else quit! Please help me! Thanks

I think you need to get legal advice on this. Try looking up the Georgia bar association and contacting them to see if you can get free legal counsel somewhere on this issue. Contact any lawyers that you might know or friends might know of to see if they can be of some help.

2nd the legal advice, and before that delete this (and any other) statement. It can similarly be used against you if found.

That said, I've been through a employer dispute in GA. It was very simple on my part, took about 6~8 weeks and was found in my favor. Granted, I was so clearly in the right it wasn't even funny. You did, technically, turn down the work. You never said the you were fired, you simply stopped working. Yes, it's due to medical conditions on your end, but that is not the employers fault.
