Sure it does.

Lane-splitting increases the chances of an accident involving another motorist. But allowing helmet-less riding doesn't raise the chances of accidents for other motorists - it just increases likelihood of severe injury or death in the case of the fools who don't wear helmets and are then in accidents.

The legal canon focuses more on limiting the ways foolish people can cause harm to others than to themselves.

Actually it doesn't. Lane-splitting reduces the chances of getting in an accident. The California Highway Patrol has published a study showing how it increases safety of motorcyclists if they lane-split in traffic.

As with most things, there are guidelines they suggest. I lived in SoCal for over 3 years, rode motorcycle for all of it and never had an issue. I had more close calls driving our Jeep than I did my Triumph MC.
